A federal judge on Friday denied a motion to stay the federal government’s probe into whether drug maker Pfizer Inc. agreed to delay a patent on its erectile dysfunction drug Viagra to allow a generic competitor to win approval, a ruling that could give the pharmaceutical company a “clear legal obligation” to keep its Viagra patent.
“The motion is denied and the government shall continue to pursue its claim for damages against Pfizer in its complaint,” Judge Claire B. Schlossberg said in a statement.
